2. ACCEPTANCE OF TERMS
By accessing or using our website, placing an order, or purchasing any product from Diatomite Australia, you confirm that you:

3. PRODUCTS
3.1 Product Descriptions
We take reasonable care to ensure all product descriptions, images, specifications, and pricing on our website are accurate. However we do not warrant that product descriptions or other content are entirely accurate, complete, or error-free. If a product you receive differs materially from its description please contact us.
3.2 Product Use
Our diatomaceous earth products are natural mineral products. Customers are responsible for ensuring the product is suitable and used appropriately for their intended application. We provide guidance on product use through our website, Safety Data Sheets, and product labelling — please read all product information before use.
3.3 Product Grades
Different grades of diatomaceous earth are suitable for different applications. It is the customer’s responsibility to select the appropriate grade for their intended use. If you are unsure please contact us before purchasing.
3.4 Safety Data Sheets
Safety Data Sheets (SDS) are available for all our products upon request. Please email info@diatomiteaustralia.com.au to request an SDS before use if required for your workplace or application.
3.5 Stock Availability
All products are subject to availability. We reserve the right to limit quantities, discontinue products, or refuse orders at our discretion. If a product is unavailable after you have placed an order we will contact you promptly.
3.6 Local Pickup Products
Certain products — currently including our 15kg bags — are available for local pickup only from Mount Garnet QLD 4872. These products will be clearly indicated on the product page. Please contact us to arrange a pickup time before placing your order.
4. PRICING AND PAYMENT
4.1 Pricing
All prices displayed on our website are in Australian Dollars (AUD) and include GST unless otherwise stated. Prices are subject to change without notice. The price applicable to your order is the price displayed at the time you complete your purchase.
4.2 GST
Diatomite Australia is registered for GST. A tax invoice including GST details will be provided with your order confirmation.
4.3 Payment Methods
We accept payment via credit card and debit card through our secure payment gateway (Stripe). Payment is processed at the time of order. We do not store your card details — all payment processing is handled securely by Stripe.
4.4 Payment Security
Our website uses SSL encryption and all payments are processed through Stripe’s secure payment gateway. We take reasonable steps to protect your financial information however we cannot guarantee the absolute security of data transmitted over the internet.
4.5 Distributor and Wholesale Orders
Wholesale and distributor orders are subject to separate pricing and payment terms as agreed in writing between the parties. Payment for distributor orders is required 7 days prior to scheduled delivery to confirm logistics and secure your place on the next delivery run.
5. SHIPPING AND DELIVERY
5.1 Free Shipping
We offer free shipping Australia-wide on all retail orders for products listed with free shipping on our website. Free shipping applies to standard delivery via Australia Post or our nominated courier service.
5.2 Delivery Timeframes
We aim to dispatch orders within 2-3 business days of payment being received. Estimated delivery timeframes after dispatch are:
Metropolitan areas: 3-5 business days
Regional areas: 5-10 business days
Remote areas: may take longer
These are estimates only and are not guaranteed. We are not responsible for delays caused by Australia Post, couriers, or circumstances beyond our control.
5.3 Delivery Address
It is your responsibility to provide a correct and complete delivery address. We are not responsible for orders lost or delayed due to incorrect addresses provided by the customer. Re-delivery costs arising from incorrect addresses may be charged to the customer.
5.4 Risk and Title
Risk in the products passes to you upon delivery. Title in the products passes to you upon receipt of full payment.
5.5 Undeliverable Parcels
If a parcel is returned to us as undeliverable we will contact you to arrange re-delivery. Additional postage costs may apply.
6. RETURNS AND REFUNDS
6.1 Australian Consumer Law
Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the products repaired or replaced if the products fail to be of acceptable quality and the failure does not amount to a major failure.
6.2 Change of Mind Returns
We do not offer refunds or exchanges for change of mind purchases. Please choose carefully before purchasing. If you are unsure about a product please contact us before ordering.
6.3 Damaged or Incorrect Orders
If your order arrives damaged or you receive an incorrect product please contact us at info@diatomiteaustralia.com.au within 48 hours of receiving your order. Please include your order number and photographs of the damage or incorrect item. We will arrange a replacement or refund at our discretion.
6.4 Return Process
If a return is approved we will provide instructions for returning the product. Products must be returned in their original packaging and unused condition unless the return is due to damage or a product fault. Return postage costs are the responsibility of the customer unless the return is due to our error or a product fault.
6.5 Refund Processing
Approved refunds will be processed to your original payment method within 5-10 business days of us receiving the returned product.
7. PRODUCT DISCLAIMER AND LIMITATION OF LIABILITY
7.1 General Disclaimer
Our diatomaceous earth products are natural mineral products. While we provide information on product uses and applications, this information is provided as general guidance only. Results may vary depending on application, environmental conditions, and other factors outside our control.

Information provided on the use of our products in stock feed, crop production, and livestock management is provided for general guidance only. Customers are responsible for ensuring compliance with all applicable Australian agricultural regulations and for seeking independent advice from qualified agricultural professionals for their specific circumstances.
7.3 Pest Control Use
Our products work by mechanical action and results may vary. We make no guarantee that our products will eliminate any specific pest infestation. For severe infestations we recommend consulting a licensed pest control professional in addition to using our products.
7.4 Industrial and Commercial Use
Customers using our products for industrial, commercial, or workplace applications are responsible for ensuring compliance with all applicable workplace health and safety regulations, including the requirement to maintain Safety Data Sheets for all hazardous substances in the workplace.
7.5 Limitation of Liability
To the maximum extent permitted by law, Diatomite Australia’s liability for any claim arising from the purchase or use of our products is limited to the purchase price of the relevant product. We are not liable for any indirect, consequential, special, or economic loss including but not limited to loss of profit, loss of revenue, or loss of business opportunity.
7.6 Indemnity
You agree to indemnify and hold harmless Diatomite Australia, BSiO2 Pty Ltd, and their officers, employees, and agents from any claim, loss, damage, cost, or expense arising from your misuse of our products, breach of these terms, or violation of any applicable law.
8. INTELLECTUAL PROPERTY
8.1 Ownership
All content on our website including text, images, logos, graphics, product descriptions, and code is the property of BSiO2 Pty Ltd trading as Diatomite Australia or our content suppliers and is protected by Australian copyright law.
8.2 Permitted Use
You may view, download, and print content from our website for your personal, non-commercial use only. You must not reproduce, distribute, modify, publish, or use our content for commercial purposes without our prior written consent.

11.5 Discount codes have no cash value and cannot be exchanged for cash.
